By placing an order with HitechDesign, you confirm that you are in agreement with
and bound by the terms and conditions below.
Definitions:
The Client : The company or individual requesting the services of HitechDesign HitechDesign:
Primary designer/site owner & employees or affiliates. General
HitechDesign will carry out work only where a completed Project Specification
Document is signed and agreed by both parties. The Project Specification Document
is deemed to be a written or verbal contract between HitechDesign and the client.
Intellectual Copyright: HitechDesign
will hold intellectual copyright of any material, including any source code and
original images created for the client until payment of the final invoice. At
this time it will become the property of the client. HitechDesign
cannot take responsibility for any copyright infringements caused by materials
submitted by the client. We reserve the right to refuse any material of a copyrighted
nature unless adequate proof is given of permission to use such material.
Clients Responsibilities with Regard
to Copyright: In situations where the client provides images text and
animations for their website they are legally responsible for ensuring that this
material does not infringe any copyright. Certain images provided by HitechDesign
in the construction of website(s) may have been purchased under license from stock
image suppliers. These images are generally only licensed for use on a single
website and may not be used in other publicity material. The website owner is
legally responsible for ensuring that this does not happen. If you require to
use any images supplied by HitechDesign for other purposes please contact us for
clarification. Website Design
Whilst every endeavor will be made to ensure that the website
and any scripts or programs are free of errors, HitechDesign cannot accept responsibility
for any losses incurred due to malfunction of the website or any part of it. The
website, graphics and any programming code remain the property of HitechDesign
until all outstanding accounts are paid in full. Any
scripts, cgi applications, php scripts, or software (unless specifically agreed)
written by HitechDesign remain the copyright of HitechDesign and may only be commercially
reproduced or resold with the permission of HitechDesign. Database,
Application and E-Commerce Development HitechDesign cannot take responsibility
for any losses incurred by the use of any software created for the client. Whilst
every care has been taken to ensure products are problem free and accurate, the
ultimate responsibility lies with the client in ensuring that all software is
functioning correctly before use. Any
additions to the brief will be carried out at the discretion of HitechDesign and
where no charge is made by HitechDesign for such additions, HitechDesign accept
no responsibility to ensure such additions are error free and reserve the right
to charge an according amount for any correction to these or further additions. The
client agrees to make available as soon as is reasonably possible to HitechDesign
all materials required to complete the site to the agreed standard and within
the set deadline. Quotations
The price quoted to the client is for the work agreed on the quotation only and
remains valid for 30 days from the date of the quotation. Should the client decide
that changes are required after work on the website commences, then we will accept
these changes with the provision that additional charges may have to be negotiated. Deposits
A deposit of 25% is required with any project before any design work will be carried
out. This figure does not include domain registration charges and at least one
years' agreed site hosting which must be paid in full before design work is commenced.
Deposits and domain registration and hosting costs are nonrefundable. Once
a website has been designed and completed the final balance of payment is then
due in accordance with our payment terms. We will pursue non-payment by taking
legal action if necessary. Registration
Charges All third party costs arising from the registration of a domain
name shall be met by the Client. HitechDesign will register / transfer clients
domain name(s) in the clients name, including a specified client contact, ensuring
the client has full ownership. Search Engine Promotion HitechDesign
are not responsible for the client's ongoing web site promotion. Should the client
require the site to be promoted on an ongoing basis a separate contract must be
agreed. The order in which websites are ranked in the natural search results is
controlled by the search engines. While we can optimise your site for this we
are unable to make any guarantees about the success of any search engine promotion
activity. HitechDesign can offer advice on web marketing and website promotion
under a separate contract if required Website
Hosting Whilst HitechDesign recommends hosting packages for clientsto
host websites, no guarantees can be made as to the availability or interruption
of this service by HitechDesign cannot accept liability for losses caused by the
unavailability, malfunction or interruption of this service, or for loss of turnover,
sales, revenue, profits or indirect, consequential or special loss. HitechDesign
reserve the right to refuse to handle in any way, material which may be deemed
offensive, illegal or in any way controversial, and also to terminate the free
hosting service should the necessity arise. HitechDesign
will not be liable for any costs incurred, compensation or loss of earnings due
to the unavailability of the site, its servers, software or any material provided
by its agents. Where applications or sites
are developed on servers not recommended by HitechDesign, the client is expected
to provide or seek any information, additional software, support or co-operation
pertaining to the server required in order for the application to be correctly
developed. Not all advertised services can be guaranteed to be available on hosting
packages not specified by HitechDesign. The
client is expected to test fully any application or programming relating to a
site developed by HitechDesign before being made generally available for use.
Where "bugs", errors or other issues are found after the site is live,
HitechDesign will endeavor (but is not obliged to) to correct these issues to
meet the standards of function outlined in the brief Compatibility
HitechDesign will endeavor to ensure that any developed/designed site or application
will function correctly on the server it is initially installed on and that it
will function correctly when viewed with the web browsing software specified in
the Project specification Document. HitechDesign will endeavor to ensure that
all websites are viewable in Microsoft Internet Explorer Version 6 and to an acceptable
level with Mozilla borrowers and a minimum screen resolution of 800 x 600 pixels.
HitechDesign can offer no guarantees of correct function with all browser software.
We do not guarantee any colour However, we will endeavor to and comply with clients'
browser or screen resolution requirements. Site
Problems Unfortunately malicious software, spyware, viruses and website
hacking are facts of life on today's Internet. It is highly unlikely that these
will affect your website, and HitechDesign will endeavour to protect websites
under their care from this as much as we can during its creation, but we cannot
be held responsible for problems that develop on sites after we have handed them
over to the client. IMPORTANT!
HitechDesign do not require clients to agree to any binding long-term contacts.
Clients are free to engage the services of other web design companies, agents,
or similar if they feel HitechDesign have failed to provide a satisfactory level
of service and HitechDesign will co-operate fully with any writen request from
the client to transfer holding of the clients account. However, we ask that you
do discuss this with us prior to perusing other Service Providers'. Where a client
feels HitechDesign have not met expectations, we will endeavour to resolve the
issue to the best of our ability. Payment
of Accounts A deposit of 25% is required from any new client before any
work is carried out. It is the policy of HitechDesign that any outstanding accounts
for work carried out by HitechDesign or its affiliates are required to be paid
in full, no later than 30 days from the date of the invoice unless by prior arrangement
with HitechDesign. Once
a deposit is paid and work completed you are obliged to pay the balance of payment
in full. We will contact clients via email and telephone to remind them of such
payments if they are not received when due. Credit
Card Payments Credit card payments can also be accepted via our Paypal
electronic invoice system. These are subject to a 4% surcharge. If
accounts are not settled or HitechDesign have not been contacted regarding the
delay, access to the related website may be denied and web pages removed, we will
then pass such cases to the Small Claims Court to pursue payment, non payment
can result in county court judgements (ccj's) being added to the clients credit
rating. Cancellation Should
the client wish to cancel at any point during the process they shall remain liable
for the work that has taken place and shall be invoiced accordingly. Complaints
Procedure Informal procedure Anyone who experiences a problem
with their web service provided by HitechDesign should raise the matter directly
using our online contact form to do so, giving sufficient information to locate
the material (such as an url) and clearly outlining the grounds for complaint.
HitechDesign will approach the individual responsible for the material in
question with a view to resolving the matter to the satisfaction of the complainant.
Formal complaints procedure The formal complaints procedure should
only be used where the complainant feels that the nature of the complaint is too
serious to be dealt with informally, or where a satisfactory conclusion has not
been reached after following the informal procedure. A formal complaint should
be made in writing to HitechDesign, who will acknowledge receipt and ensure that
the matter is looked into as soon as possible.
An initial response to any complaint can be expected within seven days of its
receipt; a full and considered response to the complaint should be completed within
30 days and any subsequent remedy implemented with the minimum of delay.
HitechDesign
reserve the right to amend these terms and conditions at any time.
